Copyright Policy for Reserve Materials

The collections of the Sandor Teszler Library are purchased by the college for the nonprofit educational use of Wofford’s students and faculty.  All library materials, regardless of format, are purchased with the assumption that there will be multiple uses of the materials.  The purpose of Library reserves is to make materials available as assigned by the faculty to support the educational mission of the College.

The Library’s policy on copyright for reserve materials is based on the Fair Use provisions of the U.S. Copyright Act of 1976.  Section 107 of this Act allows for the making of copies for “teaching…, scholarship, or research.”  Section 107 of the Copyright Act outlines four factors that determine whether copying of material falls under “fair use”:

  1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
  2. the nature of the copyrighted work;
  3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole
  4. the effect of the use upon the potential market for or value of the copyrighted work.

Electronic reserves is an extension of the print reserve collection, and as such must meet copyright guidelines for “fair use”.  Electronic copying and scanning of material and the provision of copyrighted materials through a network continue to be unsettled areas of the law.  The Sandor Teszler Library will make every effort to insure that their provision of materials, both electronically and in print, falls within the spirit and the letter of the “fair use” provisions of U.S. Copyright Law.

Copyright Guidelines for Reserve Materials

  1. All materials placed on reserve will be at the initiative of the faculty for the non-commercial, educational use by Wofford students.
  2. Materials being copied or scanned for reserve should be owned by the library or by the instructor.
  3. Longer works, such as long sections of a book, cannot be copied or scanned for reserve use.
  4. Faculty members are responsible for obtaining copyright permissions for copyrighted materials they wish placed on reserve that do not meet the standards for “fair use”.
  5. The standard copyright notice will appear on the first page of photocopied copyrighted materials on reserve, and on the authentication screen for electronic reserves.
  6. Access to the print reserve collection will require a valid Wofford ID.  Electronic access will be limited to authenticated Wofford users.
  7. Materials will be removed from reserve at the end of each semester.

Warning Concerning Copyright Restrictions

The United States Copyright Law (Title 17, United States Code) governs the making of photocopies or other reproductions of copyrighted material.  Under certain conditions, libraries and archives are authorized to furnish a photocopy or other reproduction.  One of these conditions is that the photocopy or reproduction may not be “used for any purposes other than private study, scholarship, or research.”  Further reproduction of these copyrighted materials by individual users not in accordance with “fair use” may be in violation of copyright law and are prohibited.
